membership terms and conditions

Members must be 18 years old or older.
Energise Health & Fitness Limited reserves the right to terminate your membership at any time should Management feel that you have acted or behaved unreasonably, or in a manner that causes offence or harm to our members, guests or staff, or anti-socially.
You agree to provide a recent photograph for the purposes of your membership and to comply with ‘Gym etiquette’, which is displayed within Energise Pentney Fitness & Spa, and online, and extends to opening hours, use of facilities and your conduct. We may change our gym etiquette if this is reasonably necessary.
There may be occasions where we have to close all, or part of, Energise Pentney Fitness & Spa. In such circumstances, you will not be entitled to any partial or full refund. We will endeavour to advise you in advance where possible, unless the issue is urgent or an emergency. Where possible we will try to ensure that any such closures are in off peak hours and are kept to a minimum.
We will not be liable for or responsible for any failure to perform any of our obligations under this agreement which are caused by any event that is outside our reasonable control.
health & safety
Our staff, agents and subcontractors are not medically qualified so if you have any doubts about your fitness or capability to exercise, we strongly recommend that you get advice from a doctor first. You will be required to complete and sign a medical questionnaire on joining, and it is your responsibility to make us aware of any conditions that may affect use.
Please be aware that our swimming pool, and outdoor heated vitality pool, are not under constant supervision. If you have a medical condition that may affect your safety or wellbeing, we strongly advise you are accompanied whilst swimming.
For safety reasons, you are responsible for correctly using all facilities and reading information signs, and agree to keep to the conditions of your membership, which are available within Energise Pentney and online. We strongly advise that all members complete an induction to the gym and you should ask for one if we do not offer you one. If you are not sure how to use any equipment, always ask a member of staff.
Members may bring guests to use the facilities at Energise Pentney Fitness & Spa. Guests will be required to complete a disclaimer and are responsible for their own health and safety. Members are responsible for the conduct and behaviour of their guests, and we reserve the right to ask them to leave should Management feel that they have acted or behaved unreasonably, or in a manner that causes offence or harm to our members, guests or staff, or anti-socially.
Personal Trainers (PT) at Energise Pentney Fitness & Spa are self-employed and any service they provide or any other third party provides is a contract between them and you. We will not be liable for, or responsible for any monies paid to a PT or other third party. PT and other third party services are arranged directly with the trainer or third party and not with ourselves.
We will not be liable to you for any loss, damage or theft of any property you bring onto our premises, or for any vehicles or property within a vehicle on our site.
We can make reasonable changes to these terms and conditions at any time (see website for latest version). Additional terms and conditions might be agreed on specific membership types i.e. corporate, partnerships, promotions etc. Such terms will be shown in conjunction with any offer or agreement and may supersede these terms which will be agreed in writing. membership payments and cancellation
Memberships can be paid either upfront by lump sum or by monthly direct debit.
Members who elect to take the 12 month upfront lump sum plan will be entitled to 1 month a free membership. If you pay your membership fees upfront in one single lump sum, your membership will automatically end once you have completed this term, unless you choose to renew your membership.
If you pay your membership fees monthly by direct debit, you can cease your membership at any point by cancelling your direct debit instruction with your bank. We are entitled to keep any membership fees we receive if you have not cancelled your direct debit instruction with your bank. No refunds will be issued once payment has been received.
Your membership payments will continue monthly and will be collected by direct debit until you cancel your direct debit instruction with your bank.
If you are paying by direct debit and you fall behind with your membership fees and this is not caused by a bank error, we may charge reasonable administration fees or suspend or cancel your membership; and we may pass your details to a debt-collection company to recover any outstanding payments.
If you are paying a monthly membership the due date for your payment will fall on the same date of the month that you submitted your joining forms (e.g. you joined on 12th March, and all subsequent payment will be due on the 12th of every month of membership). If payment has not been received by this date, you may be refused admittance to Energise Pentney Fitness & Spa.
We may decide to increase our membership fees, or introduce administration fees, but your fees will not increase during your current membership. We will give you a minimum of 14 days' notice of any fee change. If you cancel your membership and re-join at a future date, you will be charged the updated membership rate, if applicable. If you pay your membership fees upfront as a lump sum payment, we will only review your membership fees when your membership is due for renewal.
Membership cards are the property of Energise Health and Fitness Limited.
On cancellation of your membership you are required to return your membership card(s) in person to Energise Pentney Fitness & Spa, or by post to Energise Pentney Fitness & Spa, Low Road, Pentney, King’s Lynn, Norfolk PE32 1JF.
Energise Pentney Fitness & Spa is owned and managed by Energise Health and Fitness Limited (company number 11316395) which is registered in England and Wales.
